Heritage Act 2017

Any person or body may make a written submission to the Heritage Council in relation to a recommendation of the Executive Director that a place, object or land should or should not be included in the Heritage Register.

A submission under subsection (1) must be made in the prescribed form.

A submission must be made within 60 days after the date on which a notice of recommendation in relation to the place, object or land is published under section 41.

A submission must relate to—

for a place or object nominated under section 27, whether or not the place or object is of State‑level cultural heritage significance; or

for an object nominated under section 27A, whether or not the object is integral to understanding the cultural heritage significance of a registered place or a place nominated under section 27; or

for land nominated under section 27B—

whether or not the State‑level cultural significance of the place would be substantially less if the additional land or any part of the additional land which is or has been used in conjunction with the place were developed; or

if the additional land surrounds the place, whether or not it is important to the protection or conservation of the place or contributes to the understanding of the place; or

any recommendation under section 37, 38 or 39 in relation to the place, object or land.

A submission may include a request for a hearing before the Heritage Council in relation to the submission.
