88 Offences in relation to negligently performing certain activities
A person must not negligently remove, relocate or demolish, damage or despoil, develop or alter, or excavate, all or any part of a registered place.
Penalty: In the case of a natural person, 2400 penalty units or imprisonment for 2 years or both;
In the case of a body corporate, 4800 penalty units.
A person must not negligently remove, relocate or demolish, damage or despoil, or alter, a registered object.
Penalty: In the case of a natural person, 2400 penalty units or imprisonment for 2 years or both;
In the case of a body corporate, 4800 penalty units.
A person must not negligently disturb the position of an object that is a fixed registered object.
Penalty: In the case of a natural person, 2400 penalty units or imprisonment for 2 years or both;
In the case of a body corporate, 4800 penalty units.
Subsections (1), (2) and (3) do not apply to works or activities—

carried out in accordance with a permit issued under Part 4 or this Part; or
carried out in accordance with section 90; or
carried out in accordance with section 91; or

that are specified in a show cause notice and which are carried out consistently with the show cause notice; or
S. 88(4)(cb) inserted by No. 5/2023 s. 58(b).
carried out in accordance with a repair order; or
S. 88(4)(cc) inserted by No. 5/2023 s. 58(b).
carried out in accordance with a rectification order; or
for which the Heritage Council or the Executive Director has determined that a permit is not required under this Act.
An offence against subsection (1), (2) or (3) is an indictable offence.
