63.08 Default order

(1)

If an order is made for costs in default of defence under Part 1 of Order 21 or compliance under Part 2 of Order 21, unless the Court otherwise orders, the costs must not be taxed but must be fixed by a registrar in accordance with the appropriate scale in Appendix A.

(2)

Where costs are fixed under paragraph (1), the party by whom or the party to whom the costs are payable may appeal to the Costs Court, in accordance with the Rules of the Supreme Court, in respect of the amount so fixed on the ground that the registrar did not fix the proper amount.
