Subject to sections 81 and 82, the Minister must ensure that an initial payment is made, in accordance with the regulations, to an eligible person in relation to the relevant transmission interest of—

an amount calculated in accordance with the prescribed method; or

if the Minister considers that exceptional circumstances exist, an amount greater than the amount described in paragraph (a) calculated in accordance with any guidelines made under section 79(1)(b).

In determining whether exceptional circumstances exist for the purposes of subsection (1)(b), the Minister—

must have regard to any guidelines made under section 79(1)(a); and

may take into account any other matter that the Minister considers appropriate.

The Minister must ensure that a payment to an eligible person under subsection (1) is made on or before the prescribed day.
