National Electricity (Victoria) Act 2005

Subject to sections 81 and 82, the Minister, for each relevant year, must make, in accordance with the regulations, a payment to an eligible person in relation to the relevant transmission interest of either—

an amount calculated in accordance with section 78; or

if the Minister considers that exceptional circumstances exist, an amount greater than the amount described in paragraph (a) calculated in accordance with any guidelines made under section 79(1)(b).

In determining whether exceptional circumstances exist for the purposes of subsection (1)(b), the Minister—

must have regard to any guidelines made under section 79(1)(a); and

may take into account any other matter that the Minister considers appropriate.

The Minister must ensure that a payment to an eligible person under subsection (1) is made on or before the prescribed day.

In this section—

the year beginning on the prescribed day; and

each subsequent year for the prescribed period or, if no period is prescribed, for a period of 23 years.
