511B Procedure if the Authority proposes to refuse to grant plant design registration

(1)

If the Authority proposes to refuse to grant a plant design registration under regulation 511A, the Authority must give the applicant written notice—

(a)

informing the applicant of the reasons for the proposed refusal; and

(b)

inviting the applicant to make a submission to the Authority, within a specified period of not less than 14 days, in relation to the proposed refusal.

(2)

Within 30 days after the end of the period specified for the purposes of subregulation (1)(b), the Authority must—

(a)

consider any submission made by, or on behalf of, the applicant before the end of the period specified for the purposes of subregulation (1)(b); and

(b)

decide whether it will grant or refuse to grant the registration; and

(c)

give the applicant written notice of that decision.
