88ZB Recovery of costs
(1)
This section applies if—
(a)
a person fails to comply with a port operator direction; and
(b)
as a result, the port of Melbourne operator incurs costs in enforcing compliance with the port operator direction.
(2)
The port of Melbourne operator is entitled to recover from the person the reasonable costs incurred by it as a debt in a court of competent jurisdiction.
(3)
A certificate issued by the port of Melbourne operator certifying as to the reasonable costs incurred by it in enforcing compliance with a port operator direction is evidence of the matters certified.
