55 Grounds for disciplinary action
Each of the following is a ground on which disciplinary action may be taken in respect of a registered professional engineer—
the registered professional engineer has contravened—
this Act or the regulations under this Act; or
a prescribed Act or law or a prescribed provision of a prescribed Act or law;
the registered professional engineer has engaged in unsatisfactory professional conduct;
the registered professional engineer no longer meets the eligibility criteria for an area of engineering in respect of which the registered professional engineer is registered;
the registered professional engineer is not a fit and proper person to provide professional engineering services in an area of engineering in respect of which the registered professional engineer is registered;
the registered professional engineer obtained registration, or any required insurance, on the basis of information or a document that was false or misleading;
the registered professional engineer has failed to comply with a condition of the registered professional engineer's registration;
the registered professional engineer has failed to comply with an undertaking given to the Director under this Act, or to the Victorian Building Authority under the Building Act 1993;
the registered professional engineer has not paid a fee or other amount required to be paid under—
this Act or the regulations; or
a prescribed Act or law.
The Director may make inquiries to determine whether a ground exists for taking disciplinary action under this Part.
