40 Declaration of interests in property

(1)
In a proceeding between domestic partners or caring partners with respect to existing title or rights in respect of property, a court may declare the title or rights, if any, that a domestic partner or caring partner has in respect of the property.
(2)
The court may make orders to give effect to the declaration, including orders about possession.
