43 Time limit for making applications

If domestic partners or caring partners have ended their domestic relationship or registered caring relationship, an application to a court for an order referred to in section 41(1) must be made within 2 years after the day on which the relationship ended.

A court may grant leave to a domestic partner or a caring partner to apply for an order at any time after the end of the period referred to in subsection (1) if the court is satisfied that greater hardship would be caused to the partner applying if that leave were not granted than would be caused to the other partner if that leave were granted.
