Power to detain person under authority of police detention decision

(1)

This section applies if a police detention decision is made in relation to a person.

(2)

While the police detention decision is in effect in relation to a person—

(a)

any police officer may take the person into custody; and

(b)

any police officer may detain the person.

(3)

A police officer may, for the purpose of taking a person into custody under a police detention decision or preventing the person from escaping from detention under this Part, exercise any of the powers that the officer would have if the officer were apprehending the person under a belief on reasonable grounds that the person—

(a)

had committed an indictable offence in Victoria; or

(b)

was escaping from legal custody.

(4)

Subsection (3) does not apply to the extent to which particular powers are provided for in this Part.
