4I Full disclosure to a Public Interest Monitor
The following persons must fully disclose to a Public Interest Monitor all matters of which they are aware that are adverse to the making of a police detention decision or the conduct of a periodic review—
the authorised police officer who made the police detention decision;
the nominated senior police officer in relation to a periodic review they conduct;
a police officer exercising powers or performing duties under Part 2AA.
An authorised police officer, a nominated senior police officer or a police officer exercising powers or performing duties under Part 2AA must not knowingly or recklessly fail to comply with subsection (1).
Penalty: Level 9 imprisonment (6 months maximum) or a level 9 fine (60 penalty units maximum) or both.
