Subject to subsection (1A), proceedings for an offence under this Act or for an infringement referred to in section 38 may be brought by a police officer or an inspector.

Proceedings for an offence under Division 1A of Part 2 or Part 3AA or 3AAB may not be brought by an inspector.

Proceedings shall not be brought for an offence under section 9 without the consent in writing of the Minister.
