33 Unauthorised disclosure of information on Victorian Early Childhood Worker Register

(1)

A person must not disclose information obtained by that person from the Victorian Early Childhood Worker Register unless the disclosure is permitted by subsection (2).

Penalty: In the case of a natural person, 60 penalty units;

In the case of a body corporate, 300 penalty units.

(2)

A disclosure is permitted if the disclosure is made—

(a)

with the consent of the person to whom the information relates; or

(b)

to a court or tribunal in the course of a legal proceeding or pursuant to an order of the court or tribunal; or

(c)

as required, authorised or permitted by or under this Act or any other Act or law.

(3)

Subsection (1) does not apply if the disclosure is of information that is in the public domain at the time that the disclosure is made.
