52 Transfer of staff and entitlements
On the commencement day, all persons who were employees of the superseded Authority immediately before the commencement day are taken to be employees of the Authority on the same terms and conditions and with the same accrued and accruing entitlements as applied to those persons immediately before the commencement day as employees of the superseded Authority.
If subsection (1) applies to a person—
the service of the person as an employee of the Authority is to be regarded for all purposes as having been continuous with the service of the employee with the superseded Authority; and
the person is not entitled to receive any payment or other benefit by reason only of having ceased to be an employee of the superseded Authority.
Nothing in this section prevents an employee of the superseded Authority from resigning or being dismissed at any time after the commencement day in accordance with the terms and conditions of the employee's employment.
If a person who becomes an employee of the Authority under this section was, immediately before the commencement day, an officer within the meaning of the State Superannuation Act 1988 or a corresponding previous enactment, the person continues, subject to that Act, to be an officer within the meaning of that Act while the person is an employee of the Authority.
