Nothing in this Act applies to or in relation to an industrial dispute which the Australian Industrial Relations Commission is empowered to prevent or settle by conciliation or arbitration.
Nothing in this Act shall apply to anything done or omitted to be done in pursuance of a boycott of a vital State project if the boycott—
is a boycott primarily intended to promote or protect the bona fide interests of the members of an organization in or in relation to their wages and conditions of employment; and
has been approved by a ballot conducted under and in accordance with section 9.
