22 Fixing of tolls and toll administration fees
The relevant West Gate Tunnel Corporation in accordance with this Act and the West Gate Tunnel Agreement by notice published in the Government Gazette may—
specify toll zones on the West Gate Tunnel tollway; and
fix tolls that are payable in respect of the use of vehicles in toll zones; and
in the case that the West Gate Tunnel Agreement expressly provides for the fixing of toll administration fees that are payable to the relevant West Gate Tunnel Corporation and specification of the circumstances in which the fees are payable, fix toll administration fees and specify circumstances in which the fees are payable.
A notice under subsection (1) may specify different tolls and toll administration fees in respect of different cases or classes of cases including different zones or groups of zones, different classes of vehicle and the use of different vehicles at different times or any combination of these.
A notice under subsection (1) takes effect on the day that it is published in the Government Gazette or, if a later day is specified in the notice, on that later day.
A day fixed under subsection (3) in relation to the West Gate Tunnel tollway or a part of the West Gate Tunnel tollway must be on or after the day fixed under section 23 for the commencement of tolling on the West Gate Tunnel tollway or that part of the West Gate Tunnel tollway.
In any proceedings under this Part, the production of a Government Gazette purporting to contain a notice is evidence of the valid publication of the notice and of the fixing of the toll or toll administration fee in accordance with this Act and the West Gate Tunnel Agreement.
