Pending VCAT application made under Part 2 taken to be made under Part 4.3 of the Act

In force

(1)

On and after the commencement of section 120 of the Social Services Regulation Amendment (Child Safety, Complaints and Worker Regulation) Act 2025—

(a)

an application made to VCAT before that commencement under section 105 or 106 of the Act as applied by Division 2 of Part 2 is taken to be an application made under Part 4.3 of the Act; and

(b)

Part 4.3 of the Act (as modified by section 171(4) of the Act) continues to apply to that application.

(2)

Without limiting section 171(4) of the Act, section 106(5) of the Act continues to apply to the application as if a reference to "Secretary" is taken to include a reference to "Regulator".
