21 Transitional provisions relating to reinstatement of incorporation (s. 211)
(1)
Subregulation (2) applies if —
(a)
the incorporation of an association was cancelled under section 35(2) of the repealed Act; and
(b)
the Commissioner is satisfied that —
(i)
the incorporation of the association should not have been cancelled; and
(ii)
the association has not become incorporated under any other Act or law.
(2)
If this subregulation applies —
(a)
the Commissioner may reinstate the incorporation of the association under section 151(1) of the Act as if that incorporation had been cancelled under Part 10 of the Act; and
(b)
section 151(2), (3) and (4) of the Act apply accordingly.
