122 Biodiversity conservation covenant
An owner of land (the covenantor) may enter into a covenant (a biodiversity conservation covenant) with the CEO to set aside the land or part of the land for one or more of the following purposes —
the conservation, protection or management of biodiversity or biodiversity components on the land;
the conservation, protection or management of —
a specially protected species that occurs on the land; or
a threatened species that occurs on the land; or
a threatened ecological community that occurs on the land;
scientific purposes consistent with a purpose referred to in paragraph (a) or (b);
public education purposes consistent with a purpose referred to in paragraph (a) or (b).
A biodiversity conservation covenant may be expressed to have effect for a period of time or in perpetuity.
A biodiversity conservation covenant may do one or more of the following —
restrict the use of the covenant land;
restrict the nature of works that may be carried out on the covenant land;
require that action specified in the covenant be taken on the covenant land;
require that action be taken in a manner specified in the covenant on the covenant land.
Different provisions of a biodiversity conservation covenant may be expressed to apply to different parts of the covenant land.
A biodiversity conservation covenant must be in a form approved by the Registrar.
