275 Confidentiality

(1)

A person who is or has been engaged in the performance of functions under this Act must not, directly or indirectly, record, disclose or make use of any information obtained in the course of duty except —

(a)

for the purpose of, or in connection with, performing a function under this Act; or

(b)

as required or allowed under this Act or another written law; or

(c)

for the purposes of any legal proceedings arising under this Act; or

(d)

with the written consent of the person to whom the information relates; or

(e)

in prescribed circumstances.

Penalty for this subsection: a fine of $20 000.

(2)

Subsection (1) does not extend to the recording, disclosure or use of statistical or other information that could not reasonably be expected to lead to the identification of any person to whom it relates.
