38 Nominations in respect of certain listings
A person may nominate to the Minister —
a native species for listing as a threatened species in a particular category; or
an amendment to or repeal of the listing of a threatened species; or
an ecological community for listing as a threatened ecological community in a particular category; or
an amendment to or repeal of the listing of a threatened ecological community; or
a threatening process for listing as a key threatening process; or
an amendment to or repeal of the listing of a key threatening process.
A nomination may be made at any time and whether or not nominations have been sought under subsection (4).
The Minister may, by written notice given to the person who makes a nomination, reject the nomination if the Minister is satisfied that —
it is vexatious, frivolous or not made in good faith; or
it has not been made in accordance with any prescribed requirement.
The Minister may, by notice published in accordance with the regulations, seek nominations.
The regulations may regulate the way in which nominations are made and the form in which they are made.
