The Minister may, by instrument, adopt as a recovery plan a plan made by any of the following, whether or not the plan is in force —

another State, a self‑governing Territory or the Commonwealth;

an agency of another State, a self‑governing Territory or the Commonwealth.

The Minister may adopt a plan as a recovery plan with such modifications as are specified in the instrument.

The Minister must not adopt a plan under subsection (1) unless the Minister —

is satisfied that the proposed plan meets the requirements of section 82(2) and (3); and

has had regard to —

any submissions made under section 94 or requests made under section 95(2) in respect of the proposed plan; and

the matters referred to in section 97.
