103 Birds

A person must not take or disturb a bird of a species specified in Schedule 4 unless —

(a)

in the case of a bird specified in Schedule 4 item 1, 2, 3, 5, 6 or 9 — the bird is causing, or is reasonably expected to cause, economic damage; and

(b)

in all cases —

(i)

the taking or disturbance is by means of a firearm; or

(ii)

the disturbance is by means of a noise or light generating device.

Penalty: a fine of $10 000.
