72 Bioprospecting licence
A bioprospecting licence authorises the holder of the licence to take fauna or flora for a bioprospecting activity.
A bioprospecting licence does not authorise a person to take fauna or flora that belongs to a threatened species unless an authorisation relating to the threatened species has been given to the person by the Minister under section 40 of the Act.
A bioprospecting licence does not authorise a person to take flora on private land.
Without limiting any other provision of these regulations, a bioprospecting licence may include a condition that requires the holder of the licence to enter into an arrangement with the CEO for the sharing of profits or for the provision of other benefits to the State.
