Return of registration certificate
37 Return of registration certificate
If a person’s registration is —
amended or suspended by the Board; or
amended, cancelled or suspended by the State Administrative Tribunal,
the person must return his or her registration certificate to the Board no later than 14 days after the person is notified of the amendment, suspension or cancellation.
Penalty: a fine of $5 000.
The Board may direct in writing that a person is not obliged to comply with subsection (1) and, in that case, the subsection does not apply to that person.
The Board must return the registration certificate to the person as soon as practicable —
if the registration is amended — after amending the registration certificate to reflect the amendment; or
if the registration is suspended and is still current at the end of the suspension period — after the end of the suspension period.
It is a defence to a prosecution for an offence against subsection (1) for the accused to show that the failure to return the certificate was due to its loss or destruction.
