25B Confidential information may be disclosed to Commissioner
In this section —
confidential information, in relation to a matter, means information given to a person who acts under section 11(3) in the matter.
A person who has confidential information in relation to a matter that is the subject of a request under section 25A may disclose the information if the Small Business Commissioner so requires.

25C. Commissioner to issue certificate if matter not resolved etc.
The Small Business Commissioner must, on the request of a person who may, under this Act, make an application, referral or submission to the Tribunal, issue a certificate to the person if the Commissioner is satisfied that —
the matter is unlikely to be resolved with the assistance of alternative dispute resolution; or
it would not be reasonable in the circumstances to commence an alternative dispute resolution proceeding in respect of the matter; or
alternative dispute resolution has failed to resolve the matter.
The certificate is to be in a form approved by the Small Business Commissioner and may include any information about the conduct of the parties that the Commissioner considers appropriate in the circumstances.
