87 Notice of proposed cancellation or suspension
If the CEO proposes to cancel or suspend a licence, the CEO is to give to the holder of the licence written notice of the proposal and the CEO’s reasons for the proposal.
A notice given under subregulation (1) is to state that within a specified number of days after the notice is given, the person to whom it is given may make written representations to the CEO concerning the proposal and the CEO is not to give effect to the proposal without considering any representations received within that period.
The number of days to be specified in a notice under subregulation (2) is to be not less than —
21 days in the case of a proposal to cancel a licence; or
7 days in the case of a proposal to suspend a licence.
If for any reason a notice cannot be given to a person under subregulation (1), when read with section 76 of the Interpretation Act 1984, the CEO may give the notice to that person by publishing a copy of the notice addressed to that person in a newspaper circulating in the area in which the person was last known to be.
