11WK Deemed contract where customer takes gas without making arrangements

(1)

This section applies if a customer commences to take a supply of gas at premises without entering into a contract for that supply with the holder of a trading licence.

(2)

The gas is deemed to be supplied under the standard form contract of the default supplier for the delivery point in respect of those premises, as determined under the provisions mentioned in section 11WL.

(3)

The contract referred to in subsection (2) continues in force until —

(a)

it is terminated; or

(b)

the supply of gas to the customer at the premises by the default supplier becomes subject to a non‑standard contract with that supplier.

(4)

The regulations may provide that, where this section applies, any term, condition, or provision of a standard form contract —

(a)

does not have effect; or

(b)

has effect as if it had been modified as provided for in the regulations.
