11ZOT Enforcement of section 11ZOR
If, in the opinion of the Authority, a person who is a gas distribution operator or a retail gas operator has contravened section 11ZOR, the Authority may cause a notice to be served on the person requiring that the contravention be rectified within a specified period.
If, in the opinion of the Authority, the person fails to comply with a notice under subsection (1), the Authority may in writing order the person to pay a daily monetary penalty fixed by the Authority, but not exceeding $10 000.
For the purposes of subsection (2), the daily penalty is a penalty for each day on which the person acts in contravention of section 11ZOR.
The Authority is not to make an order under subsection (2) unless the person has been —
notified in writing of the proposed order; and
given a reasonable opportunity to show why the order should not be made.
The Authority may recover a penalty imposed under subsection (2) in a court of competent jurisdiction as a debt due by the person to the Crown.
