4 Meaning of “underground fuel tank”
For the purposes of these regulations, a tank is at a particular time an underground fuel tank if it —
(a)
is used to store organic liquids;
(b)
is wholly or substantially underground;
(c)
has a capacity exceeding 12 kilolitres; and
(d)
either —
(i)
has received more than 600 kilolitres of organic liquids during the 12 month period immediately before that time; or
(ii)
is likely to receive more than 600 kilolitres of organic liquids during any 12 month period that includes that time.
