379 Protection of identity of person providing information to Commissioner
A person must not disclose information (identifying information) that might identify or tend to identify a person as a person who has provided information to the Commissioner under this Division.
Penalty for this subsection: imprisonment for 2 years and a fine of $24 000.
A person does not commit an offence under subsection (1) if —
the person who provided the information to the Commissioner consents to the disclosure of the identifying information; or
it is necessary to disclose the identifying information to enable the matter to be investigated effectively; or
there are reasonable grounds to believe that disclosing the identifying information is necessary to prevent or minimise the risk of injury to a person or damage to property; or
the identifying information is disclosed in accordance with an order of a court or a person or body having authority to hear, receive and examine evidence.
