52R Public health warning statements
The Director may publish a statement setting out the name of a health care worker if the Director has commenced an investigation under this Act in relation to a health care worker and the Director reasonably believes that —
the health care worker has failed to comply with a code of conduct that applies to the health care worker; and
it is necessary to publish the statement to avoid an imminent and serious risk to —
the life, health, safety or welfare of a person; or
the health, safety or welfare of the public.
The Director may publish a statement setting out the name of a health care worker if —
either —
after completing an investigation under this Act, the Director is satisfied that the health care worker has failed to comply with a code of conduct applying to the health care worker; or
the health care worker has been convicted of a prescribed offence;
and
the Director reasonably believes that it is necessary to publish the statement to avoid a serious risk to —
the life, health, safety or welfare of a person; or
the health, safety or welfare of the public.
The Director may set out in a public health warning statement any other details that are reasonably relevant to advise the public of the serious risk identified by the Director.
A public health warning statement —
must be published on the Office’s website; and
may be published in any other manner that the Director considers appropriate.
