Repayment of compensation
134 Repayment of compensation
In this section —
prescribed period means a period prescribed for the purposes of this section that commences on the payment of compensation to a person under section 133.
This section applies to a person if the person —
is paid compensation under section 133; and
is subsequently —
employed in a department or organisation; or
engaged by an employing authority within the meaning of this Act or the PSM Act under a contract for services.
A person employed or engaged as mentioned in subsection (2)(b) before the expiry of the prescribed period in relation to that person must refund to the Treasurer an amount that bears to the amount of the compensation the same proportion as the unexpired portion of that period bears to that period.
If a person who is required to comply with subsection (3) does not do so, the amount unrefunded may be recovered by the Treasurer in a court of competent jurisdiction as a debt owed by that person to the State.
