Health Services Act 2016

A health service provider (the first provider) may enter into a contract or other arrangement with another health service provider (the second provider) to —

provide health services to, or receive health services from, the second provider; or

have the second provider provide health services on behalf of the first provider; or

provide services other than health services to, or receive other services from, the second provider.

The power to enter into contracts or other arrangements under subsection (1) is subject to —

sections 37 and 38; and

the limitation that a health service provider must not enter a contract to provide a health service mentioned in section 7(2)(a) and (b) unless the provision of the health service is within the health service area for which the health service provider is established under section 32(1); and

other limitations, or the conditions, imposed by a relevant service agreement under section 48(1)(b).
