Restrictions on power to dispose of land
37 Restrictions on power to dispose of land
In this section —
health service land means —
land vested in, or held by, a health service provider under this Act; or
land acquired by a health service provider.
The power of a health service provider to dispose of land does not extend to the transfer of Crown land for an estate in fee simple.
A health service provider may only dispose of health service land if —
the health service provider has the Minister’s written agreement to dispose of the land; or
the disposal is of a class of disposals that has been exempted from the requirement to obtain the Minister’s written agreement by order made by the Minister and published in the Gazette.
The Minister may, by order published in the Gazette, revoke or amend an order made under subsection (3)(b).
