40F Power to remove Crown land or conservation land from operation of s. 40E
The Minister may, by notice published in the Gazette, declare that section 40E does not apply to Crown land or conservation land that is —
the subject of a specified exploration licence; or
in a specified block (within the meaning of Part IV Division 2); or
in a specified area of the State.
The Minister may, by notice published in the Gazette, vary or cancel a notice under subsection (1).
A notice under this section takes effect on the day on which the notice is published in the Gazette or such later day as is specified in the notice.
A notice under this section does not affect the operation of a permit issued under section 40E before the day on which the notice takes effect.
