Notice to royalty payer of amounts or methods decided by Minister or Commissioner
47 Notice to royalty payer of amounts or methods decided by Minister or Commissioner
This regulation applies if, under a provision of these regulations, the Minister or the Commissioner may decide an amount, a value, a method or something else and the decision (a relevant decision) is relevant to working out the royalty payable for a mineral.
The Commissioner must ensure that a royalty payer who is required to pay a royalty for a mineral worked out using the amount, value, method or other thing decided by the Minister or the Commissioner is given notice of each relevant decision.
A royalty payer is taken to have been given notice of a relevant decision if the amount, value, method or other thing, or information about it —
is published on the Commissioner’s website; or
is made available to the royalty payer through the facility on the Commissioner’s website used for filing electronic versions of royalty returns.
