When notice or other document is served or given
50 When notice or other document is served or given
A notice or other document is given to, or served on, a person —
if the document is personally given to, or served on, the person — when it is given or served; or
if the document is sent by post to an address —
on the day it is taken to have been delivered to the address under subregulation (2); or
if it is proven to have been delivered to the address on a day after that day — on the day on which it is proven to have been delivered;
or
in any other case — on the business day after the day on which the document, addressed to the person, is sent to, left for or otherwise communicated to the person.
A document sent by post to an address is taken to have been given to, or served on, the person to whom it is addressed —
if sent to an address in the State — on the 4th business day after the day on which the document is sent; or
if sent to an address outside the State but in Australia — on the 6th business day after the day on which the document is sent; or
if sent to an address outside Australia — on the 14th business day after the day on which the document is sent.
