Planning and Development Act 2005

to advise the Minister in relation to the coordination and promotion of planning for integrated and sustainable development in the State;

to advise and assist the Minister in relation to the administration, revision and reform of legislation relating to development and planning for development;

to prepare and maintain the following as a basis for coordinating and promoting planning for integrated and sustainable development in the State and to provide guidance for public authorities and local governments on those matters —

a planning strategy for the State to be approved by the Minister;

planning strategies for the parts of the State to which region planning schemes apply;

other planning strategies as agreed between the Minister and the Commission;

State planning policies under Part 3;

planning codes under Part 3A;

other documents, including plans, policies, guidance and operational documents;

to plan for the coordinated provision of transport and infrastructure to support development;

to undertake research, and to prepare planning methods and models, relating to the following —

integrated and sustainable development;

planning for such development;

other matters relating to such development;

to provide advice and assistance to local governments and other persons or bodies in relation to development and planning for development, including advice and assistance in relation to the following —

planning schemes;

functions that are under planning schemes or that otherwise relate to development and planning for development, including functions that relate to referring, consulting on or advertising applications for approval of development or instruments made under this Act or planning schemes;

to prepare, maintain and administer region planning schemes under Part 4;

to prepare, maintain and administer interim development orders under Part 6;

to declare planning control areas and administer those areas under Part 7;

to prepare, maintain and administer improvement plans and improvement schemes under Part 8;

to prepare, maintain and administer the Swan Valley Planning Scheme under the Swan Valley Planning Act 2020;

to provide advice and assistance to the Minister in relation to the matters referred to in paragraphs (g) to (k);

to provide advice and assistance to the Minister in relation to local planning schemes, and amendments to those schemes, made or proposed under Part 5;

to acquire land for the purpose of implementing region planning schemes, improvement schemes and the Swan Valley Planning Scheme;

to develop, maintain and manage land held by the Commission for the purpose of implementing a region planning scheme, an improvement scheme or the Swan Valley Planning Scheme, including carrying out works and providing facilities on the land that are —

incidental to the development, maintenance or management of the land; or

conducive to the use of the land for any purpose for which the land is reserved;

to deal with matters relating to subdivisions of land under Part 10;

to deal with development applications under Parts 11B and 17;

to do all things that are necessary for the purpose of carrying out this Act, region planning schemes, improvement schemes and the Swan Valley Planning Scheme;

any other functions conferred on the Commission under this Act, the Swan Valley Planning Act 2020 or any other written law.
