32C Effect of planning code
A planning code approved by the Minister under regulations made under section 32B(1) is subsidiary legislation for the purposes of the Interpretation Act 1984.
Despite subsection (1), a planning code has effect only to the extent that it is incorporated, with or without modifications —
into a local planning scheme by a provision of the scheme under section 77(1)(b); or
into an improvement scheme by a provision of the scheme under section 77(1)(b) (as that section applies under section 122B(1)); or
into the Swan Valley Planning Scheme under the Swan Valley Planning Act 2020 section 11(1)(a).
