Minister may make transfer order
72 Minister may make transfer order
To facilitate the transition from the provisions of the Transport Co‑ordination Act 1966 Part II Division 4 to the provisions of this Act, the Minister may make and publish in the Gazette an order that —
specifies any asset or liability that, by operation of section 73, is to be assigned to the Authority;
specifies proceedings relating to the administration of the Transport Co‑ordination Act 1966 Part II Division 4 in which the Authority is, by operation of section 73, to be substituted for a former holder as a party; and
specifies any agreement or instrument relating to the administration of the Transport Co‑ordination Act 1966 Part II Division 4 that, by operation of section 73, is to have effect as if, unless otherwise expressly specified in the order, references to the Authority were substituted for references in it to a former holder.
The transfer order may specify things by reference to schedules which —
need not be published in the Gazette; but
must be available for public inspection,
and anything specified in a schedule is to be taken to be specified in the order.
Anything may be specified in a transfer order by describing the class to which it belongs.
Before a transfer order is made specifying anything by reference to a schedule, a copy of which will be required to be delivered to a relevant official under section 75, the Minister is to consult as to the form and content of the schedule with the relevant official (or each relevant official if there is more than one).
A transfer order can only be made before the transfer time.
The fact that a previous transfer order has been made does not prevent a further transfer order from being made.
The transfer order, or a schedule to which it refers, may be amended by the Minister, by further order published in the Gazette, but no such amendment may be made after the transfer time.
