Contracting out

In force

(1)

Except as specifically provided by this Act —

(a)

any contract, agreement, scheme or arrangement, whether it was made before or after the commencement of this Act, has no effect to the extent that it purports to exclude, modify or restrict the operation of this Act; and

(b)

any purported waiver of a right conferred by or under this Act has no effect.

(2)

A person must not enter into any contract, agreement or arrangement with the intention, either directly or indirectly, of defeating, evading or preventing the operation of this Act.

Penalty for this subsection: a fine of $10 000.
