17A Disputes between tenants
Where 2 or more tenants under a residential tenancy agreement are jointly liable under the agreement to pay an amount to the lessor and one of the tenants (the first tenant) pays another tenant’s portion of that amount, the first tenant may apply to a competent court for an order that the other tenant pay to the first tenant the other tenant’s portion.
The court hearing the application may —
make the order referred to in subsection (1); and
order the payment of compensation to the first tenant by the other tenant for loss or injury, other than personal injury, caused by a failure by the other tenant to pay that tenant’s portion of the amount referred to in subsection (1); and
make such ancillary or incidental order as the court considers appropriate.
