10E Transfer of wagering licence
A wagering licensee that is a body corporate may, with the approval of the Minister, transfer the wagering licence to a related body corporate as defined in the Corporations Act 2001 (Commonwealth) section 9 (the new licensee).
The wagering licensee may apply to the Minister to approve the transfer.
The application must be —
made at least 60 days before the day of the intended transfer; and
made in a form approved by the Minister; and
accompanied by such information and documents as the Minister requires.
The Minister may approve the transfer if the Minister, after consulting the Commission, determines that the transfer is in the public interest.
Section 10A(2) applies to the Minister’s approval of the transfer as if a reference in that provision to the applicant were a reference to the new licensee.
If the Minister approves the transfer —
the Minister may make any necessary amendments to the wagering licence; and
any costs incurred by the Minister may be recovered as a debt due to the State in a court of competent jurisdiction; and
for the purposes of this Part, the new licensee is taken to have been granted the licence under section 10A.
