Veterinary Practice Act 2021

In proceedings under this Act, in the absence of evidence to the contrary —

an allegation in a prosecution notice of any of the matters described in subsection (2) is taken to be proved; and

the following are taken to be proved —

that a document purporting to have been given or executed by the Board was given or executed by the Board;

that a document purporting to have been signed or certified by a Board member, the registrar or an inspector was signed or certified by someone who was, at the time, such a person;

that a document purporting to have been signed by a delegate of the Board was signed by a person who was, at the time, a delegate and authorised to sign it;

a document purporting to be a certificate of registration of a veterinarian, a veterinary nurse or veterinary premises is evidence of the matters stated in it.

It may be alleged that at a specified time or during a specified period a specified person was —

a Board member or the deputy of a Board member; or

the chairperson of the Board; or

a member of a committee; or

the registrar, an inspector or another person employed or engaged by the Board.
