194 False or misleading information
A person commits an offence if the person —
in, or in connection with, a Part 2 application or Part 3 application, provides information that the person knows is false or misleading in a material particular; or
in purporting to comply with a direction under section 94(1)(b) or 115(2)(c), gives an answer or provides information that the person knows is false or misleading in a material particular; or
in purporting to comply with a direction under section 94(1)(a)(ii) or 115(2)(a), produces a document that the person knows is false or misleading in a material particular —
without indicating that the document is false or misleading and, to the extent the person can, how the document is false or misleading; and
if the person has or can reasonably obtain the correct information, without providing the correct information;
or
in purporting to give notice under Part 5 Division 5, provides information that the person knows is false or misleading in a material particular.
Penalty:
for a first offence, a fine of $10 000;
for a second or subsequent offence, a fine of $20 000.
