Breach of code of practice

(1)

A breach of a code of practice issued under section 198 does not of itself constitute unprofessional conduct or professional misconduct but in any proceedings under Part 7 such a breach may be asserted and may be taken into account in dealing with the complaint.

(2)

However, no civil or criminal liability attaches to a person by reason only that the person has committed a breach of a code of practice issued under section 198.
