82 Time for complaint
A complaint may be made about the conduct of a person irrespective of when the conduct the subject of the complaint occurred or allegedly occurred.
However, the Board cannot deal with a complaint if the complaint is made more than 3 years after the conduct that is the basis of the complaint is alleged to have occurred unless the Board determines that —
it is just and fair to deal with the complaint having regard to the delay and the reasons for the delay; and
it is in the public interest to deal with the complaint.
A determination under subsection (2) is final and cannot be challenged in any proceedings by the complainant or the respondent.
