A party that engages a professional services provider to conduct activities involving the party's employees can recover by way of contractual damages the full amount of its tortious liability to an injured employee, where the provider's breach of the implied term of reasonable care caused the injury. This is so notwithstanding that the engaging party was itself a co-tortfeasor and that liability was apportioned between them under contribution legislation. The contractual indemnity operates independently of the statutory contribution regime.
